Social media privacy policy

In accordance with current regulations, ENCOMENDA CAPITAL PARTNERS SGEIC, S.A. (hereinafter, “ENCOMENDA”) informs users that it has created profiles on the social networks X (formerly Twitter)Instagram, and LinkedIn, with the main purpose of promoting its products and services.

Data:

ENCOMENDA has access to and processes public information available on the user’s profile, in particular, the contact name. These data are used exclusively within the Social Network itself.

The user has a profile on the same Social Network and has decided to join ENCOMENDA’s page, thus showing interest in the information published there. By joining our page, the user gives ENCOMENDA consent to process the personal data published in their profile.

The user may access the privacy policies of each Social Network at any time and configure their own profile to ensure their privacy.

Purposes for which data are used on social networks

The information and personal data voluntarily provided by the user through ENCOMENDA’s social media profiles are processed for the following purposes:

  • To publish on the social network information, advertising, and commercial promotion of ENCOMENDA’s products, services, and activities.
  • To publish on the social network information, advertising, and commercial promotion of products, services, and activities of third-party companies with which ENCOMENDA has collaboration agreements.
  • To learn about the user’s opinions and feedback.
  • To access the public information of the user’s profile.
  • To send personal and individual messages through the social network’s messaging channels.

Publications

Once the user has joined ENCOMENDA’s page, they may post comments, links, images, photographs, or any other type of multimedia content supported by the Social Network, doing so freely, voluntarily, and consciously. The user must, in all cases, be the owner of such content, hold the corresponding copyrights or intellectual property rights, or have consent from affected third parties.

The publication of any content on the page—whether text, graphics, photographs, videos, etc.—that may offend or potentially offend morality, ethics, good taste, or decency, or that infringes upon intellectual or industrial property rights, image rights, or the law, is strictly prohibited. In such cases, ENCOMENDA reserves the right to immediately remove such content and may request the permanent blocking of the user.

ENCOMENDA will not be responsible for content freely published by a user.

The user should be aware that their posts will be visible to other users and, therefore, they are primarily responsible for their own privacy.
Users may always control their connections, delete content that is no longer of interest, and restrict who they share their connections with by adjusting their privacy settings.

Images published on ENCOMENDA’s page will not be stored in any file by ENCOMENDA, but will remain on the Social Network.

Advertising

ENCOMENDA will use the Social Network to advertise its products and services. In any case, if ENCOMENDA decides to use the contact data of users for direct marketing or commercial prospecting actions, it will always do so in compliance with applicable data protection regulations.

It will not be considered advertising to recommend ENCOMENDA’s page to other users so that they may also enjoy promotions or be informed of its activities.

Data protection rights

At any time, users may exercise their rights—limited to the functionalities of the social network—by contacting ENCOMENDA to confirm whether their personal data are being processed by the company and, if so, to access such data. Users may also request the correction of inaccurate data or request their deletion when, among other reasons, the data are no longer necessary for the purposes for which they were collected.

In certain circumstances, users may request the restriction of processing, in which case the data will be retained only for the exercise or defense of claims. Users may also object to the processing of their data in specific cases. ENCOMENDA will cease processing unless there are compelling legitimate reasons or for the exercise or defense of potential claims. Finally, when applicable, users may exercise the right to data portability to obtain their data in electronic format or have them transmitted to another entity.

ENCOMENDA reserves the right to make changes to this Social Media Privacy Policy, and users are advised to review it periodically. When significant changes occur that may have legal implications for users, ENCOMENDA will communicate such changes, while also allowing users to access the policy at any time to remain informed and up to date.
